New Jersey Lemon Law
Many people have misconceptions about the so-called “lemon law.” You buy a car, and its keeps breaking down, you assume you have purchased a “lemon.” New Jersey has both a new and used car lemon law. Each is different.
New Car Lemon Law
This law applies to new vehicles, either purchase or lease, that have some defect wtihin the first 24 months or 18,000 miles. If you sue under the new car lemon law, your case will be against the manufacturer of the vehicle and not the dealer from which you purchased the car. Remember, you must give the manufacturer the opportunity to fix the problem before filing a lawsuit.
Used Car Lemon Law
The used car lemon law in New Jersey is different in that your case will be against the dealership instead of the manufacturer. State law requires dealers to warrant the used vehicles they sell if they are less that 8 years old and meet certain mileage requirements.
Consumer Fraud
Deceptive businesses, such as certain auto dealerships and car repair shops, take advantage of vulnerable consumers. Innocent individuals are sold cars with covered-up water damage, rolled-back mileage, and other undisclosed defects. In addition, dealerships and dishonest dealers provide misleading information to reach the bottom line – get the sale at all costs.
If you have been victimized by auto dealer fraud or other consumer fraud, you deserve justice. These shady businesspersons should be held accountable for their fraudulent conduct. An experienced consumer fraud attorney can help you advocate for your rights and fight to recover your money.
